Terms of Service

1. Acceptance of Terms
By accessing or using GetStyled.io (the "Service"), operated by JMV Labs LLC (doing business as "GetStyled," "we," "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
These Terms apply to all users, including salon owners, staff members, and end-user clients who book appointments through the platform.
2. Description of Service
GetStyled provides a cloud-based salon and beauty business management platform, including:
- Online appointment booking and scheduling
- Client relationship management (CRM)
- Staff management and scheduling
- Email and SMS marketing campaigns
- Business analytics and reporting
- Public salon directory listing
- Payment processing (via Stripe)
3. Account Registration
- You must be at least 18 years old to create an account.
- You must provide accurate, current, and complete information during registration.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized access to your account.
4. Free Trial and Subscription Plans
Free Trial: New accounts receive a 14-day free trial of the Starter plan. No credit card is required for the trial period.
Paid Plans: After the trial period, you must subscribe to a paid plan to continue using the Service. Plans and pricing are described on our Pricing page.
Billing: Subscriptions are billed monthly or annually in advance. All fees are non-refundable except as described below or as required by law.
Refund Policy: We offer a full refund if requested within 7 days of your first paid subscription charge. After this period, subscriptions are non-refundable, but you may cancel at any time to prevent future charges. Annual subscribers who cancel mid-term will retain access until the end of their billing period but are not entitled to a prorated refund. Refunds for service outages or billing errors are handled on a case-by-case basis—contact support@getstyled.io.
Changes: We may modify pricing with 30 days advance notice. Price changes do not affect the current billing period.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Send unsolicited spam or marketing emails/SMS without proper consent from recipients
- Upload or transmit viruses, malware, or other harmful code
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers
- Scrape, crawl, or use automated means to access the Service without permission
- Impersonate another person or entity
- Use the Service to collect personal data of individuals without their consent
- Violate CAN-SPAM, TCPA, GDPR, or other applicable communication laws
6. Your Data and Responsibilities
Data Controller: As a salon owner using our platform, you are the data controller for client information you collect. You are responsible for obtaining appropriate consent from your clients before entering their data into the Service.
Data Processor: GetStyled acts as a data processor on your behalf. We process client data only as necessary to provide the Service and in accordance with our Privacy Policy.
Compliance: You are responsible for complying with all applicable data protection laws (GDPR, CCPA, etc.) in your use of the Service, including obtaining proper consent for email and SMS communications to your clients.
Backup: While we maintain regular backups, you are responsible for maintaining independent copies of critical business data.
7. Intellectual Property
Our IP: The Service, including its design, code, features, and documentation, is owned by GetStyled and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.
Your Content: You retain ownership of all content you upload (photos, text, business information). By uploading content, you grant us a license to use it solely to provide the Service (e.g., displaying your salon listing in the directory).
Feedback: Any suggestions, ideas, or feedback you provide may be used by us without obligation to you.
8. Third-Party Services
The Service integrates with third-party providers:
- Stripe: Payment processing, subject to Stripe's Terms of Service.
- AWS SES: Email delivery services.
- SMS Providers: Text message delivery for notifications and marketing.
We are not responsible for the availability or conduct of third-party services.
9. Service Availability
We strive for 99.9% uptime but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We will provide reasonable advance notice of planned downtime when possible.
10. Termination
By You: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
By Us: We may suspend or terminate your account if you violate these Terms, fail to pay fees, or engage in activity that harms the Service or other users. We will provide notice and an opportunity to cure when feasible.
Effect of Termination: Upon termination, your access to the Service will cease. You may request a data export within 30 days of termination. After 30 days, your data will be permanently deleted.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be error-free, secure, or available at all times. We are not liable for any loss of data, revenue, or business opportunities arising from use of the Service.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GETSTYLED'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.
IN NO EVENT SHALL GETSTYLED BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, REGARDLESS OF THE THEORY OF LIABILITY.
13. Indemnification
You agree to indemnify and hold harmless GetStyled, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, violation of these Terms, or violation of any third-party rights.
14. Dispute Resolution
Governing Law: These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
Arbitration: Any disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, except that either party may seek injunctive relief in court.
Class Action Waiver: You agree that disputes will be resolved on an individual basis and waive any right to participate in a class action.
Small Claims: Either party may bring claims in small claims court if the claim qualifies.
15. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect via email or in-app notification. Continued use of the Service after changes take effect constitutes acceptance.
